Summary

This bill enacts the New Mexico Wildlife Protection and Public Safety Act prohibiting:

  • setting, using or attempting to set or use, a trap to kill or capture wildlife on public land;
  • setting, using or attempting to set or use, a body-gripping trap to kill or capture any feral or domestic animal on public land;
  • applying, using or attempting to apply or use, any poison to kill or injure wildlife or a feral animal on public land; or
  • buying, selling, bartering or otherwise exchanging for profit or offering to buy, sell, barter or otherwise exchange for profit the raw fur of any protected or unprotected fur-bearing animal taken by a trap or poison.

 

The bill lists specific exhibitions to the prohibitions and details the specific conditions under which each exception applies.

 

A violation of the act is a misdemeanor for a first offense and a fourth degree felony for a second or subsequent conviction.

 

A potential benefit of this bill might be a reduction in unnecessary and indiscriminate trapping, poisoning, killing and injuring wildlife and other animals on public land, including the trapping and poisoning of fur-bearing animals for profit.
