Summary

This measure provides additional requirements that must be met for the incorporation of a municipality. One of those requirements is that the petitioner must present a “municipal services and revenue plan.” The plan must “demonstrate that the proposed municipality will provide at least three of the following services and that it will have a tax base sufficient to pay the costs of those services . . ..” The listed services include, among others:

  • road and street construction;
  • solid waste management;
  • water supply or distribution or both;
  • wastewater treatment;
  • storm water collection and disposal;
  • electric or gas utility services;
  • enforcement of building, housing, plumbing and electrical codes and other similar codes;
  • planning and zoning; and
  • recreational facilities.

 

A benefit of this bill may be that it will help to ensure the integrity of future municipalities and help prevent the creation of municipalities that do not provide needed services for their residents. A possible concern might bet that the proposed municipality must only provide three of the listed services even though they all are integral to the effective functioning of a municipality.

This bill is a companion bill to Senate Bill 438.
