Summary
This bill would amend the New Mexico Mining Act to exclude “humate” from the definitions of “minerals” and “mining” and thus from the jurisdiction of the Mining Act.
Possible concerns might be an increase in the size of humate mining operations without any reclamation requirement; increased fugitive dust emissions from humate mining activities; and an increased threat to surface water in the form of suspended solids.
