Summary
This bill excludes tanks used by crop dusting or crop spraying services from the definition of “above ground storage tank” subject to the provisions of the Hazardous Waste Act and the Ground Water Protection Act.
On February 25th the House Agriculture, Water & Wildlife Committee amended HB 459 to provide that the bill’s exclusion from the definition of “above ground storage tank” is limited to fuel storage tanks used solely by crop dusting or crop spraying services.
A possible concern regarding this bill is the potential for contamination of land and water by spills from fuel storage tanks used by crop dusting or spraying services due to the elimination of controls otherwise imposed by the Hazardous Waste and Ground Water Protection Acts.
