This bill, with the emergency clause, clarifies that a lease of a water right and subsequent use of water will not take effect until after the application is made, notice and opportunity for hearing is provided, and the application is approved by the State Engineer.

 

A potential benefit of this bill might be that the parties to a water rights lease will be less likely to “jump the gun” and act as if the lease has been approved when it has not.
