Summary

This bill, with the emergency clause, would authorize the Water Quality Control Commission to set the time and place of hearings on regulations or water quality standards.

 

The current statute requires that hearings on regulations or water quality standards of statewide application shall be held in Santa Fe; and that hearings on regulations or standards that are not of statewide application may be held within the area that is substantially affected by the regulation or standard.

 

A possible concern is that such hearings could be held in locations that would make attendance difficult or impossible for those most affected by proposed regulations or water quality standards.

 

On February 16th HB 87 was amended on the House Floor to require that the commission must set the time and place of hearings on regulations or water quality standards within the area that is substantially affected by the regulation or standard.

 

A possible benefit of the House Floor amendment is that hearings are more likely to be held in locations that are convenient for those most affected by proposed regulations or water quality standards.
