This bill, with the emergency clause, enacts the Utility Infrastructure Expansion Act. It requires that the PRC adopt rules to provide for a natural gas public utility to expand its infrastructure for the delivery or supply of natural gas. And it provides for recovery by a natural gas public utility of costs associated with the utility’s infrastructure expansion.

A possible benefit of this bill might be greater statewide supply and availability of natural gas. A potential concern might be increased costs to consumers of natural gas.

On February 3 the House Energy, Environment and Natural Resources Committee amended a subsection regarding rules to be promulgated by the PRC to elaborate on the process to be followed by a natural gas public utility in applying cost-recovery methodologies to the utility’s customers who receive benefits from the expansion activity, and “to ensure that no person is unjustly enriched at customers’ expense.”

A possible benefit of the bill as amended is that additional attention may be paid to ensuring fairness to customers in the allocation of any increased costs to them.
