Summary

This legislation creates the Upper Pecos River Public Water Works Authority as a political subdivision of the State. The legislation is very similar to the current statutory section that created the Lower Grande Public Water Works Authority at § 73-26-1 NMSA 1978. The authority is composed of the El Valle Water Alliance, which in turn is composed of the communities of Lower Colonias, San Juan, El Coruco, San Miguel del Bado, La Sacatosa and Villanueva in San Miguel County.

 

The purposes of the Authority are:

  • constructing infrastructure and furnishing water and wastewater services for domestic, commercial or industrial uses;
  • the protection of the authority’s infrastructure;
  • renewable energy projects that are integral to the operation and maintenance of the authority’s facilities or any combination or parts thereof; and,
  • entering into agreements with other entities for the provision of other services, including water conservation and reclamation, source water protection, planning and zoning.

 

The bill sets forth a number of provisions that govern the Authority’s powers and operations. The Authority will be subject to the rules of the NMED and the NMED will have some oversight over the Authority. It will not be subject to the jurisdiction of the Public Regulation Commission. It may issue bonds to raise revenue.

 

One benefit of this measure might be that it will bring economies of scale to the operations of the member and thus may allow for improved operations that lead to water and energy conservation. An question might regard how the Lower Grande Public Water Works Authority is functioning and what results its operation has netted.

 

This bill is a companion bill to SB 274.
