This piece of legislation amends the Sunshine Portal Transparency Act to:

  • remove the definition of “exempt employee.”
  • expand the definition of “state agency” to include “agency” and “office or institution,” specifically including educational institutions, and setting forth that the agency, etc. may in the executive, legislative or judicial branches of State government.
  • include exempt employees in the state directory of employees and to include employee names in the directory, except for undercover peace officers and those employees who have filed for an order of protection pursuant to law.
  • The agency or other governmental employer may also exclude the name of an employee if it determines that publishing the name would endanger the employee’s personal safety or the safety of the public.

 

A potential benefit of this bill might be expanded access by the public to State government information.

The HLC adopted a substitute bill on February 20, 2012 that achieves the same purpose. It leaves in the definition of “exempt employee” that exists in current law and then defines a “classified employee” as one who is not exempt. The substitute requires the directory to be of all classified and exempt employees and to note whether each employee is classified or exempt.

Outcome: HB 426 passed the House (44-24) and died in the Senate Judiciary Committee.
