Summary

This measure amends a current section of the Subdivision Act that requires water permits for a County Commission’s final approval of a subdivision plat. The bill makes the following changes to current law:

  • It condenses two sections into one section (no longer need separate section for pre-1977 timeframe).
  • It lowers the number of lots from twenty lots to ten to be contained in the proposed subdivision in order for the proposal to trigger the application of this section of law.
  • It prohibits a County Commission from approving a final plat if the State Engineer has not issued water use permits, rather than giving the Commission the discretion not to approve the plat.
  • It prohibits the State Engineer from approving a permit application if the proposed source of water is a domestic well.

 

This bill may be a positive step towards ensuring that subdivisions will have adequate supplies of water.

 

The SJC Committee Substitute adopted on March 4, 2013 hinges plat approval on “providing proof of a service commitment from a water provider and an opinion from the state engineer that the subdivider can fulfill” the subdivision’s water requirements OR a permit.

 

This bill is not a companion bill to Senate Bill 479, but is related.
