Summary

This bill authorizes penalties for violation of a county ordinance regulating the mining of rock or other materials, including but not limited to stone, sand, gravel, aggregate and riprap. Penalties may not exceed:

  • a fine of $1,000 for each day the violation exists; or
  • or imprisonment for three hundred sixty-four days;
  • or both.

 

The House Regulatory and Public Affairs Committee Substitute for HB 188 authorizes the same penalties for the same violation as the original bill, but limits the applicability of the provision to a Class A county only.

 

A possible benefit of this bill might be more effective enforcement of county mining ordinances in Class A counties.
