Summary

This bill amends a section of the Livestock Code and repeals several other sections to remove limitations and conditions on the prohibition against allowing livestock to run at large. The amendment instead provides broadly, without restrictions or conditions, that an owner who willfully allows livestock to run on the lands of another is guilty of a misdemeanor and upon conviction will be punished in accordance with the provisions of Section 31-19-1 NMSA 1978.

 

The responsibility for impounding livestock found running at large and selling them at public auction (if they are not redeemed by the owner by payment of fees and costs) is assigned to the New Mexico Livestock Board.

 

A potential benefit of this bill might be the prevention of damage to public and private property, and degradation of the environment, by livestock that otherwise are allowed to run at large without consequence to their owners.
