Summary

This bill amends the Water-Use Leasing Act so that pueblos may lease a water use that is due under an adjudicated water right pursuant to certain settlement agreements approved in federal law. The lease may be for a term set forth in the federal law. This pueblo right to lease will not apply to any water use due under any state-law based water rights acquired by or for a pueblo.

 

This bill may prove to be neutral in terms of water supply and use and might simply allow pueblos to generate revenue by leasing the right. One question may be why it is needed and another may be what is the purpose.

 

This bill is a companion bill to SB164.

Outcome:

HB 222 passed the House (64-0) and passed the Senate (39-0) and was signed by the Governor on March 8, 2014.
