Summary
Under this measure, the New Mexico Environment Department (NMED) will compile a list at least every 12 months of the contaminants for which it will test public water supply systems under its Public Water Supply Program. The bill allows funds from the Water Conservation Fund to be used to develop the list and perform the tests. The NMED is required to adopt rules that establish the procedure for compiling the list and determining whether other contaminants should be added to the list. That determination will include the availability of funds, the needs of the public water supplies being tested, public health and safety, and other factors that the NMED determines.
One benefit of this measure might that it could help to ensure safer public water supplies.
Update: HENRC adopted a Committee Substitute for the bill on February 15, 2013. The substitute appears to simplify the bill by generally referring to contaminants that will be tested in the next 12 months rather than referring two separate categories, those that are already tested and “additional contaminants.” The FIR provides detailed information on this bill, though as of this writing is not updated to reflect the changes made in the substitute bill.
Update: The House Floor Substitute for the bill was adopted and passed on February 19, 2013. The substitute removes language that would have allowed the costs of creating the list to be paid from the Water Conservation Fund.
Outcome: HB 415 passed the House (65-0) and Senate (40-0), and was signed into law on April 2nd, 2013.
