Summary

This bill provides that private, noncommercial boat docks will be permitted on all lakes and reservoirs that are owned by the Interstate Stream Commission and jointly managed by the commission and the State Parks Division of the EMNRD, provided that:

(1)    each applicant for a boat dock permit shall own real property contiguous to the proposed location of the boat dock; and

(2)    boat docks shall comply with rules promulgated by the division pertaining to the construction and maintenance of private, noncommercial boat docks.

 

The annual fee charged for a boat dock permit will not exceed $500.

 

The division will promulgate rules setting forth safety requirements to be applied to boat docks during periods of drought when docks are not floating.

 

A possible benefit of this bill might be enhanced access to lakes and reservoirs for recreational boating. A potential concern is that private docks that don’t provide access to the public proliferate and negatively impact the recreational character and appearance of lakes and reservoirs.
