Summary

This joint resolution proposes to amend Article 11, Section 1 of the Constitution of New Mexico to reduce the number of PRC commissioners from five to three and to provide that they will be appointed by the governor, with the advice and consent of the Senate, from districts as provided by law, which initially will be the same as the state’s three Congressional districts.

 

Appointments will be for staggered four-year terms. No more than two commissioners may be members of the same political party.

 

A potential concern regarding this bill is that democratically elected PRC commissioners will be replaced with commissioners appointed, and therefore effectively controlled, by the governor, turning the PRC from an independent body into an instrument of partisan politics.
