Summary

This bill requires a person who is in the business of recycling, shredding or destroying plastic bulk merchandise containers must not pay for the purchase of any plastic bulk merchandise container with cash. The person must, for each transaction in which the person purchases five or more plastic bulk merchandise containers keep specific detailed records of the transaction, including the method of payment; proof of ownership; the seller’s name, address, telephone and ID numbers; etc.

 

A “plastic bulk merchandise container” is defined as a plastic crate, pallet or shell used by a product producer, distributor or retailer for the bulk transportation or storage of retail containers of milk, eggs, bakery items or bottled beverage products.

 

A person who violates the provisions of this bill will be liable for a civil penalty up to $10,000 for each violation. A civil penalty recovered by the attorney general or a county or district attorney will be paid into the current school fund.

 

A possible benefit of this bill might be a degree of prevention of improper disposal of used plastic bulk merchandise containers.
