Summary
The bill makes several amendments to the Plant Protection Act, which is implemented and enforced by the New Mexico Department of Agriculture Act and applies to nursery and florist plant stock. The Act addresses the infestation and infection of plant stock by plant pests. The amendments include:
- adding “pests” to the definitions section as an alternative to “plant pests;”
- adding the power to inspect documentation (as well as the plant stock);
- prohibiting nursery stock from being sold if it is potentially infected with plant pests;
- requiring that florist stock must be pest-free when sold; and,
- allowing the NMDA to destroy, remove from sale or manage infected or infested with plant pasts.
