Summary

This measure increases the potential size of the civil penalty to which the owner or operator of an oil or gas pipeline facility or someone who transports oil or gas is subject for violations of safety standards under the Pipeline Safety Act and its related rules with respect to intrastate pipeline facilities. Current law provides for a maximum penalty of $25,000 per day for each violation with a maximum penalty of $500,000. The bill changes that penalty to the amount established in 49 CFR Section 190.223(a) (a federal rule). That regulation provides for a penalty of $100,000 for each violation per day and a maximum penalty of $1,000,000 for any related series of violations.

Although the intent of this bill may be to increase safety for human beings by deterring violations of safety laws and rules, it might have the added benefit of protection land and water that could be harmed by some of those infractions.

Outcome: HB 285 passed the House (66-0) and died on the Senate floor calendar.
