Summary

This bill would increase the civil penalties applicable to anyone owning or operating gas or oil pipeline facilities or engaged in the transportation of gas or oil for violation of any provision of §Section 70-3-18(A) NMSA 1978, or any regulation under the Pipeline Safety Act applicable to intrastate pipeline facilities, from the current penalty limit of $25,000 per day for each violation (or related series of violations) to a maximum of $500,000 to the amount established in applicable federal law or regulation, as determined by the PRC.

For example, the 2011 federal pipeline safety act makes a number of violations subject to penalties up to $200,000 per violation, and up to $2 million for a series of violations.

A benefit of this bill might be increased regulatory compliance due to the threat of higher civil penalties for noncompliance.
