Summary
Under this measure, owners or operators of pipelines (oil and gas and related products) and other underground facilities (utility lines) will be required to verify the location of their pipelines and facilities for excavators with a positive response notice, including stating that there are no such facilities if that is the case.
A “positive response” is defined by the bill to mean a number of documented forms of communication, such as a fax or email. The purpose of the positive response is to allow the excavator to verify whether all affected pipelines and underground facilities are marked before going to the site and beginning the excavation work.
One benefit of the bill is that it might help prevent the accidental rupture of pipelines and the resulting spill of oil or gas by excavators in the event that the pipelines are not marked.
Outcome: HB 494 passed the House (68-0) and Senate (39-0) and was signed into law on April 1st, 2013.
