Summary

This bill amends sections of the Off-Highway Motor Vehicle Act to allow operation of off-highway motor vehicles (OHVs) on a paved street or highway with a speed limit of 55 miles per hour or less, unless such operation is prohibited by a local authority’s ordinance or resolution, if:
• the vehicle has brakes, mirrors and mufflers one or more headlights and taillights that comply with the Off-Highway Motor Vehicle Act; and
• the operator has a valid driver’s license or permit and an off-highway motor vehicle safety permit, is insured as required by the Mandatory Financial Responsibility Act, and is wearing eye protection and a safety helmet that comply with the Off-Highway Motor Vehicle Act.

A local authority may, by ordinance or resolution, establish separate speed limits and operating restrictions for off-highway vehicles that are authorized to operate on paved streets or highways.

Possible concerns regarding this bill might include noise and air pollution resulting from expanded use of OHVs on public roads; danger to pedestrians and to driver’s of other motor vehicles who are not accustomed to sharing the roads with OHVs.
