HB 549: LIMIT EMINENT DOMAIN FOR PIPELINES

An Act Relating To Oil And Gas; Amending Section 70-3-5 Nmsa 1978 (being Laws 1953, Chapter 42, Section 8, As Amended) To Limit Eminent Domain Authorization For Which Any Person, Firm, Association Or Corporation May Exercise The Right Of Eminent Domain For Pipelines Or Other Facilities For Conveyance Of Petroleum, Natural Gas And Carbon Dioxide Gas And The Products Derived Therefrom, Provided That No Less Than Seventy-five Percent Of The Volume Of Such Petroleum, Natural Gas And Carbon Dioxide Gas Originates In, Is Processed In Or Is Used In New Mexico.

Summary

This bill limits the power of eminent domain regarding rights of way necessary for the construction, maintenance and operation of a pipeline to rights of way for pipelines that convey petroleum, natural gas and carbon dioxide gas, no less than 75 percent of which originates in, or is processed or used in, New Mexico.

 

A possible benefit of this bill might be protection of the state’s land, air, water and human population by allowing for fewer pipelines in the state and thus reducing the risk of the release of petroleum, natural gas or carbon dioxide gas in the event of a pipeline rupture.
