  • 17-2-7.2(A) NMSA 1978 provides that a landowner or lessee may, on private land, take or kill an animal, including game animals and other quadrupeds, game birds and fowl, that presents an immediate threat to human life or an immediate threat of damage to property.

 

This bill would clarify that such immediate threat of damage to property does not include damage to crops or pastures by grazing.

 

The bill would also require that a landowner or lessee must notify the Department of Game and Fish regarding animals that present a threat of damage to crops or pastures in accordance with regulations adopted by the State Game Commission.

 

A benefit of this bill might be a reduction in unnecessary and inappropriate killing of game animals through clarification of the relevant statutory requirements and procedures.
