Summary
This bill amends current law regarding the penalties for wasting game as a result of poaching by elevating to a fourth degree felony the poaching of bighorn sheep, ibex, oryx, Barbary sheep, elk, deer or pronghorn antelope that results in the “unnecessary and wanton waste” of the game.
Poaching and wasting other game remains a misdemeanor. The default penalties for violations of Game Commission rules involving the time, extent, means or manner of that game is hunted, taken, captured, killed, possessed, sold, purchased or shipped are increased to a maximum of one year in prison or a fine ranging from $50 to $500, or both, unless otherwise set forth.
The bill adds a new penalty of $50 for fishing, hunting or trapping without the proper stamp or validation and a penalty of $125 for violating the “manner and method rule.”
Outcome: HB 55 passed the House (67-0) and died on the Senate calendar.
