Summary

Senate Bill 90 requires beneficiaries of the Arizona Water Settlements Act to secure and guarantee all funding necessary to construct a large-scale diversion and pipeline on the Gila River before the Interstate Stream Commission (ISC) can notify the Secretary of the Interior of its intent to begin construction.

The Arizona Water Settlements Act of 2004 authorized $66 million for community water projects to meet local water needs and an incentive of $34 – $62 million more if the ISC decides to divert the Gila River. With inflation the initial $66 million received in 2004 has grown to nearly $100 million. Yet, proposed Gila River diversion projects could cost as much as $440 million, leaving taxpayers responsible for the balance – $300 million or more.

This measure may benefit the State by ensuring that the State budget will not be unduly impacted by a large-scale diversion on the Gila River.

This bill relates to SB 089.
