Summary

This measure amends §72-4A-9 NMSA 1978, which creates the Water Project Fund and states its purpose. It eliminates the 10% earmark currently allocated to the State Engineer (OSE) for water rights adjudications and the 20% earmark allocated to the Administrative Office of the Courts (AOC) for the same purposed. Instead, it provides for a 10% earmark to the Natural Heritage Conservation Fund for forest and watershed restoration projects conducted in accordance with the provisions of the Natural Heritage Conservation Act (§§75-10-1 et. seq.).

 

One question regarding this bill might be whether the OSE and AOC will have adequate funding for the water rights adjudications with this change. A second might be whether the transfer to another fund might begin a raid on the Water Project Fund.

 

This bill is identical to SB 324.
