Summary
This bill enacts a new section of the State Rules Act providing that, except for rules adopted by the Taxation and Revenue Department, all rules shall expire on July 1, 2020.
After July 1, 2020:
- all rules will expire on July 1 five years from the calendar year in which the rule was published in the New Mexico Register; and
- the rule shall not be re-filed unless, prior to the expiration date, the issuing agency conducts a review of the rule to eliminate the rule if it is no longer applicable, cost-effective, timely or necessary for the implementation of the agency’s mission.
A possible concern might be that an agency might allow rules that serve a positive conservation function to lapse rather to the trouble of conducting the required review and refiling. Another concern might be that when all current rules are set to expire in 2020, the volume of rules at risk will be greater than an agency can handle reviewing.
