Summary

This bill enacts a new section of the Rural Electric Cooperative Act to provide that an electric cooperative is not obligated to provide retail utility service to persons located on lands under the jurisdiction or control of a tribe, unless the tribal government agrees that the provision of the service will be according to the same policies, terms and conditions that are applicable to the cooperative’s other members. “Tribe” is defined as an Indian nation, tribe or pueblo located in whole or in part within the state.

A possible benefit of this bill might be that it will ensure fairness and equal treatment of tribal and non-tribal customers of a rural electric cooperative.
