Summary

This measure requires the Oil Conservation Commission of the Energy, Minerals and Natural Resources Department to adopt rules by January 1, 2014 that require the operators of wells that use hydraulic fracturing, commonly known as “fracking,” to disclose the composition of the fluids used. The disclosure will be made on a “hydraulic fracturing chemical registry form” that will be posted on specified websites and will include the total volume of water used as well as each chemical ingredient.

The rules must also:

  • require the operator to submit the form to the Commission;
  • require that service companies involved in the hydraulic fracturing provide the well operator with the information necessary to make the disclosure;
  • set forth a process for the operator to designate some information as a trade secret;
  • require challengers to a trade secret claim to file the challenge with the Commission and limit the pool of challengers to the landowner on which the well is located, landowners of adjacent land, a state or federal agency; and,
  • set forth a process for an operator to provide information that is a trade secret (in this case as defined by federal rules) to health professionals and emergency responders who need the information in accordance with those federal rules.

Outcome: HB 136 died in the House Agriculture and Water Resources Committee.
