Summary

This bill is identical to Senate Bill 99 and has the same sponsor. It may be that it was introduced twice because the first entry in the Daily Bill Locator omitted the word “Reduction.”

The bill creates the Dental Amalgam Waste Reduction Act that requires dental office to remove dental amalgam from is waste stream by installing an amalgam separator by December 31, 2014. The separator must comply with international standards for removal efficiency.

Dental amalgam is defined as dental restorative material that is used to fill cavities and that typically contains mercury, silver, tin and copper, along with other metallic elements. The bill imposes reporting requirements and makes exceptions for certain types of dental offices.

The New Mexico Board of Dental Health Care will oversee compliance and enforcement of the Act and will consider non-compliance unprofessional conduct for disciplinary purposes. The Board must adopt rules by June 30, 2014.

Outcome: SB 108 died in the Senate Conservation Committee. A duplicate bill, SB 99, passed the Senate (38-2) and the House (63-6), and was signed into law on April 5th, 2013.
