This bill, for the Radioactive and Hazardous Materials Committee, provides for remediation of the danger posed by the Carlsbad brine well. It creates the Carlsbad Brine Well Remediation Authority to set policy and regulate, supervise and administer the remediation of the Carlsbad brine well. And it creates the Carlsbad Brine Well Remediation Fund and appropriates $150,000 to the fund for FY 2017 and subsequent years.

 

A potential benefit of this bill is that it may help to monitor the Carlsbad Brine Well and to prevent or remediate the effects of a collapse of the brine well cavern.

 

On February 3 the House Agriculture, Water & Wildlife Committee amended HB 112 to add the provision that any condemnation procedures shall be limited to the property where the brine well is located.

 

A potential concern is that this amendment may limit the authority’s ability to take all steps necessary to prevent or remediate the effects of a collapse of the brine well cavern.

 

On February 10 the Senate Judiciary Committee further amended SB 8 to strike the appropriation and instead authorize the authority to issue revenue bonds pursuant to a revenue source dedicated to the authority or the Carlsbad Brine Well Remediation Fund. The SJC amendment also adds sunset provisions terminating operation of the Carlsbad Brine Well Remediation Authority and repealing the act on July 1, 2028.

 

A potential benefit of this bill is that it may help to monitor the Carlsbad Brine Well and to prevent or remediate the effects of a collapse of the brine well cavern. A potential concern is that the authority’s ability to take all steps necessary to prevent or remediate the effects of a collapse of the brine well cavern may be limited.
