Summary
This bill, with the emergency clause, amends the Fireworks Licensing and Safety Act to add aerial shell kit-reloadable tubes, mines, multiple tube devices, roman candles, shells, and similar devices as fireworks that must be banned if the governing body of a municipality issues a proclamation declaring that exceptional (this level is new), extreme or severe (these two levels are in current law) drought conditions exist within the boundaries of the municipality. The findings of the governing body must be based on current drought indices published by the United States Drought Monitor and any other relevant information supplied by the Southwest Coordination Center.
The bill also provides that, upon request of the governing body of a municipality or county, the Forestry Division of the Energy, Minerals and Natural Resources Department is authorized to adopt and enforce emergency rules within the municipality or county that completely ban or partially ban or restrict the sale or use of all fireworks within the municipality or county if extreme fire danger exists within the municipality or county.
A possible benefit of this bill might be the prevention of wildfires caused by the use of fireworks during a period of extreme drought and fire danger conditions.
