Summary
This bill amends the Dee Johnson Clean Indoor Air Act to explicitly add the smoking of e-cigarettes to the act’s definition of “smoking.” The act provides that is unlawful for a person to smoke in any indoor workplace or indoor public place or in buses, taxicabs or other means of public transit not specifically exempted pursuant to the Dee Johnson Clean Indoor Air Act.
The bill defines “e-cigarette” to include “any electronic oral device, whether composed of a heating element and battery or an electronic circuit, that provides a vapor of nicotine or any other substances the use or inhalation of which simulates smoking.”
The bill also adds retail stores generally (no longer limited to tobacco stores) to the act’s list of areas where smoking is permitted.
A possible benefit of this bill is protection of non-smokers from the unwanted effects of e-cigarette vapors. A potential concern is the bill’s allowance of e-cigarette smoking in retail stores.
